Jonathan Teo, a co-founder and managing partner at Binary Capital, an early stage venture capital firm with over $300 million under management tainted by a sexual harassment scandal involving another co-founder Justin Caldbeck has been sued via tweet after allegedly avoiding summons for months in a lawsuit brought by former Binary Capital principal Anna Lai who claims she experienced harassment and defamation during her time at the firm.
Chris Baker of Baker Curtis & Schwartz PC who is representing Lai secured permission from a San Mateo County judge to serve Teo a lawsuit via his Twitter account and also in legal newspaper the Daily Journal.
Dear Mr. Teo @jonteo. You and other Binary Capital entities have been sued in the matter of Ann Lai v. Binary Capital, et. al. You’ve been served via tweet in accordance with a Court Order. The tweet was made after Baker Curtis & Schwartz made efforts to get to Teo, including hiring a private investigator and contacting Teo’s lawyer, Elizabeth McCloskey who refused a summons, court filings say.
Binary Capital co-founder Justin Caldbeck stepped down in 2017 after six women accused him of making unwanted sexual advances. Caldbeck took an indefinite leave of absence with Bloomberg reporting Binary’s fund will shut down although it still remains in operation under Teo.
Caldbeck who Lai first sued agreed to pay $85,000 in exchange for dismissal of a litigation against him. Teo, not initally a defendant in the lawsuit brought against Caldbeck was added in 2017 by Lai.
